Studii Academy:

Final Provisions
This Policy is an internally developed document, publicly available and intended for publication on Studii.md and Studii Academy website.
This Policy is subject to amendments and additions in case of new legislative and special regulations on personal data processing and protection at least once a year.
Compliance with the requirements of this Policy is monitored by persons responsible for ensuring personal data security in the Organization.
The responsibility of the Organization's employees having access to personal data for non-compliance with the rules of processing and protection of personal data is established in accordance with the legislation of the Republic of Moldova and the internal documents of the Organization.
Terms of use
Terms
1.1 Studii Academy Online School (hereinafter referred to as Online School) - an institution offering courses of study and meditation in various subjects, both with individual instruction and in groups of up to 20 people.
1.2 Website Administration (Administration/Vendor) - Limited Liability Company "SIMPALS", fiscal code 1004600001907, legal address MD-2059, Chisinau mun. Chisinau, Cala Orheului str. 28/1. The Administration shall inform the Beneficiary of any changes in the information about the Administration or of the change of the person acting on its behalf on behalf of the Administration (e.g. in case of transferring to a third party the rights and obligations to provide services and/or maintain the System) by amending this Agreement and/or subsequent Agreements.
1.3 Services/Courses - goods and services provided to the User within the framework of the Online School operation in order to fulfill the functions and use the results of the System operation in accordance with this Agreement.
1.4 Agreement - the text of this Agreement between the Beneficiary and the Administration, containing all the necessary and essential conditions for the Administration to provide access to the System, all the terms and conditions of the User's use of the School, the opportunities and conditions provided to the Beneficiary to use the Basic Services of the School, restrictions, conditions for suspension and termination of the Beneficiary's use of the School and the Basic Services provided by the School, the responsibility of both parties, other relations of the parties related to the use of the System, as well as conditions for the use of the System. Compliance with the conditions mentioned in this Agreement is a precondition for the Beneficiary to use the School and for the User to be able to use all its services.1.5 Technical Support Service - a service of the Administration that provides consulting services to the Beneficiary on the School online.
1.6 Beneficiary - a natural person to whom the Services (courses) will be provided within the framework of the Online School.
General Provisions
2.1 These Regulations are an official document and determine the procedure and conditions for the provision of the Service available to the Beneficiary who has the necessary equipment for access to the Internet, as well as access to the Internet. All issues related to the provision of access to the Internet, purchase and installation of the relevant equipment or software are not covered by these Regulations and shall be resolved by the Beneficiary independently and at its own expense outside the scope of these Regulations.
2.2 The current version of the Terms of Use is permanently available at the link: https://academy.studii.md/ru. The Administration reserves the right to modify or amend this User Agreement at any time without prior notice to the Beneficiary. The Beneficiary should independently monitor changes in this Agreement and familiarize himself with the current version of the User Agreement. Continued use of the Online School by the Beneficiary after amendments and/or additions to this Agreement shall mean the User's consent to the amendments and/or additions made.
2.3 By checking the "I agree to the privacy policy and terms of use" box, you declare that you agree to these terms and conditions of our website. Any terms and conditions that the User may wish to impose on the terms and conditions of this website are automatically excluded and are not recognized by Studii Academy.
2.4 Beneficiary agrees that it is authorized by Studii Academy only to visit and/or own a copy of the pages of this website for personal use only and that it will not duplicate, download, publish, modify or otherwise distribute material on this website for any purpose other than viewing course information for personal use or purchasing courses for personal use, unless specifically authorized by Studii Academy. The content and software on this site is the property of Studii Academy and Simpals, D.O.O.
2.5 The relationship relating to the provision of courses whose information is listed in the Online School:
(1) take place directly between the Beneficiary and the Supplier, the provider of the services indicated;
(2) an electronic certificate is issued upon completion of the course.
Terms and conditions of service
3.1 Registration for a trial lesson3.1.1 To sign up for a free trial lesson, the Beneficiary should fill in the form at https://academy.studii.md, indicating the full name of the parent and child, the child's age, contact phone number and e-mail address;
3.1.2 If you do not use our services (do not buy the course), your details will be deleted after 2 weeks. You will need to leave your details again to re-enrol for a trial lesson.
3.2 Paying for the course
3.2.1 In order to purchase a course, the Beneficiary must select Course, then on the page that opens specify:
Name/s;
Email address;
Telephone number.
3.2.2 After the Beneficiary has performed all the actions specified in Clauses 3.1 and 3.2.1 of these Rules, the secure payment page shall be "uploaded" where the Beneficiary shall:
- provide the necessary data, in addition to which the Beneficiary represents and warrants with full confidence that he/she has the rights and authorizations, has full rights to make the payment through the payment sources used by him/her in the payment in accordance with these Regulations, and is solely responsible in case of violation of the terms of the Regulations.
- confirm the selected online course order by clicking the "Pay" button (or other button, access to which confirms the consent to make the payment) and receive from the bank that issued the card (hereinafter - the "issuing bank") the confirmation of payment authorization.
- The issuing bank may refuse to authorize the payment for certain reasons provided for by the legislation in force of the Republic of Moldova, the rules of the issuing bank, relevant electronic payment system, in case it is assumed that the payment transaction is fraudulent. All issues related to the execution of the payment shall be settled by the Beneficiary with the representatives of the issuing bank, on his/her own behalf and at his/her own expense, outside this Regulation.
3.3 Access to the online course
3.3.1 The Beneficiary is solely responsible for the authenticity and correctness of the data provided by him/her in the Services and is obliged to ensure necessary and sufficient measures to prevent unauthorized access by third parties to the e-mail account or other means of communication to which only the Beneficiary has access.
3.3.2 After purchasing an online course. You will have access to a personal page opened through an individual connection link on the Studii.md platform, which the Beneficiary will receive through a personal message from the Administration, which will contain a diary with a set schedule of classes, as well as all the information necessary for the lessons.
3.4 Refund of the amount paid for the online course
3.4.1 The refund of the amount of the online course purchased by the Beneficiary is possible under the terms of these Regulations and in accordance with the rules established by the Administration.
3.4.2 a) The cost of online courses purchased with a bank card will be refunded to the account from which it was paid, within 14 calendar days from the date of confirmation of the application for refund and not more than 180 days from the date of payment (course purchase).
*Application will be submitted in electronic format to academy@studii.md. It is not necessary to come to the office of the Online School ("Simpals" O.O.O.).
b) The cost of online courses purchased with a bank card, but exceeding 180 days from the date of payment (course purchase), will be refunded to the account from which it was paid, only after confirmation by the beneficiary that the account details have not been changed, within 14 calendar days from the date of confirmation of registration of the application for refund, which will include full details of the beneficiary.
Special conditions
4.1 The Beneficiary undertakes to provide sufficient and truthful information to the extent necessary for the provision of the Services, to ensure that the information is up-to-date and accurate, and assumes the risks associated with the provision of insufficient and/or unreliable information.
4.2 The Beneficiary accepts the denial of access to the Course in the following situations:
- Payment authorization is not confirmed by the issuing bank or electronic payment system.
- Initiation of a procedure for refunding the course value to the Beneficiary, if such initiation is authorized by these Regulations and the rules established by the Provider;
4.3 The Beneficiary is fully responsible for any breach of these Regulations and for the consequences of such breaches.
4.4 The Online School undertakes not to disclose the information provided by the Beneficiary when providing the Services.
No breach, use or provision of information shall be deemed to occur in the following cases:
- In the case of the provision of Services to the extent necessary for the respective provision;
- In the transfer of information to third parties acting on the basis of contracts with the Online School (Simpals SRL) for the fulfillment of obligations to the Beneficiary;
- At the request of bodies and persons authorized to request and receive such information, in accordance with the legislation in force in the Republic of Moldova;
- In other cases with the consent of the Beneficiary.
4.5 The Beneficiary agrees that:
- Online School reserves the right to suspend or cancel the Services provided at any time without giving reasons and without prior notice to the Beneficiary. The termination or suspension of the Services may be effected including, but not limited to, violation by the Beneficiary of these Regulations and/or technical circumstances, such as improper operation of the academy.studii.md website, websites or other resources, malfunctions of electronic payment systems, etc..;
- The Service may contain links to other Internet resources, and the Online School is not responsible for the availability of such resources, their content and any other consequences that may arise from the use of materials from the said resources.
- The information specified by the Beneficiary within the Services may be provided to the Online School, duly authorized representatives to fulfill its own obligations, to ensure the Beneficiary's access to the course and to provide relevant services;
- The Service is provided "as is".
Studii Academy (Online Schools) Limitations of Liability
5.1 The Online School is not in any way, shape or form responsible or liable for the card payment processing service. The Online School is not responsible for any errors and/or fraud arising from or in connection with this service.
5.2 The Online School shall not be liable for any damage or loss caused to the Beneficiary, including, but not limited to, as a result of certain changes that the Online School makes to its web pages or other resources in the manner in which the Services are provided, as well as termination or stagnation of the Services, deletion of errors or failure to store certain data contained or transmitted, ambiguity and/or inaccuracy of data provided by the Beneficiary.
5.3 In case of force majeure. Force majeure circumstances include, but are not limited to, natural disasters, military actions, national crisis, strike in the industry or region, actions, decisions of public authorities that objectively prevent the performance of obligations under these Regulations, as well as errors that occurred in telecommunication and/or energy networks, malicious software, unfair actions of third parties, expressed in actions aimed at unauthorized access and/or deactivation of programs and/or equipment.
Amendment of these Regulations
6.1 The Online School has the right to make any changes and additions to these Regulations. All amendments and additions to these Regulations shall be published on the website academy.studii.md.6.2 Amendments and additions to these Regulations shall come into force from the moment of their publication in accordance with para. 6.1 of these Regulations, unless otherwise stipulated by the Online School. Continued use of the Online School by the Beneficiary after amendments and/or additions to this Agreement shall imply the Beneficiary's consent to the amendments and/or additions made.
Final provisions
7.1 Recognition of any provision of this Regulation as incorrect or invalid shall not be construed as invalidation of any other provision of this Regulation.7.2 The Beneficiary agrees that in case of a dispute related to or arising from this Regulation, the law of the Republic of Moldova shall apply to the substantive law.
